Terms & Conditions

The outlines Terms and Conditions will apply to your booking. Please read them carefully as they apply to all tour ticket purchase through Many Chief Tours.

 

These Terms shall constitute the entire agreement between Many Chief Tours a division of Many Chief Consulting Ltd. and the Client relating to the subject matter herein, and shall constitute a binding agreement.  There is no verbal or written representation, warranty, prior agreement or description of services, other than as expressed herein.

 

The Contract and booking are made with, and services will be provided by, Many Chief Tour – Many Chief Consulting Ltd. By booking a tour, you agree to be bound by these Terms and Conditions that govern the relationship, the cancellation policy and limitations of liability.

 

These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.

 

Prices, Surcharges, & Taxes

Tours are priced and advertised inclusive of applicable sales taxes and service charges by the ticket issuing vendor. All costs associated with purchase of the tour will be advised to the Client at time of booking and itemized on subsequent invoicing.

 

Currency

Many Chief Tours – Many Chief Consulting Ltd. packages, fees, and additional services shall be quoted in Canadian (CAD) dollars unless otherwise indicated, and shall be paid in the currency posted at the time of booking on www.manychieftours.com | Calgary, Alberta, Canada | 1-464-0196 | info@manychief.com  Many Chief Tours – Many Chief Consulting Ltd. reserves the right to apply the currency of their choosing to any tour.

 

Reservations/Payment

Any tour of one (1) day duration or less must be paid in full at time of booking. Custom tours, large groups (10 or more people) and/or other bookings at the discretion of Many Chief Tour – Many Chief Consulting Ltd. will require a minimum 50% non-refundable deposit per person per tour at the time of booking. Any outstanding balance will be billed separately and is due upon receipt of invoice.

Changes to Reservations

If you wish to change your reservation after purchase, we will try to accommodate your request based on tour availability. 2 business days is required for any requested changes.

 

Cancellation Fees & Refunds (Cancellation Policy)

If a tour is canceled up to 48 hours of the tour date, a full refund will be issued. If a tour is canceled within 48 hours of the tour date, no refund will be issued. Tickets can be exchanged for a different tour date and/or time-based on availability. In the event that Many Chief Tours – Many Chief Consulting Ltd. must cancel a tour, a refund of the amount paid will be issued to the original purchaser.

 

 

Service Provider

Many Chief Tours – Many Chief Consulting Ltd. acts only as an agent for the owners and contractors providing transportation, accommodation, or other services and is not responsible or liable for any loss, damage or injury, delay or accident due to an act of default of any company engaged in providing services included.  Scheduled changes may occur and Many Chief Tours – Many Chief Consulting Ltd. management reserves the right to make any adjustments in plans, which may be necessitated due to situations not under our control Many Chief Tours – Many Chief Consulting Ltd. is not responsible for any additional costs resulting from any expense or inconvenience caused by circumstances not under our control, for example; weather, strikes, accommodations or venue changes, and/or cancelled or delayed transportation.

 

Travelling with Children

An adult must accompany every 2 children under the age of 11. The ratio of adults to children travelling together must be one adult per two children unless prior permission has been obtained by contacting Many Chief Tours – Many Chief Consulting Ltd. All inquiries with respect to children are subject to review and approval by Many Chief Tours – Many Chief Consulting Ltd.

 

Guests with Disabilities

In order to fully enjoy your Many Chief Tours – Many Chief Consulting Ltd., we recommend that you select a tour that is suitable to your physical capabilities. Tour participants requiring any form of assistance are required to notify Many Chief Tours – Many Chief Consulting Ltd.in advance in writing prior to booking for review and our agreement. Additionally, Clients with special needs must be accompanied by an individual responsible for providing assistance. Tour guides are not trained to be able to provide such assistance. Clients must be able to understand and follow instructions given by the Tour Guide at all times.

 

Wheelchairs & Motorized Scooter

Due to physical constraints and space limitations on the bus, wheelchairs and motorized scooters cannot be accommodated.

 

Validity

The prices of Tours advertised on the Many Chief Tours – Many Chief Consulting Ltd websites are based on costs in effect at time of posting to the website Many Chief Tours – Many Chief Consulting Ltd reserves the right to amend the prices of any Tour at any time prior to receipt of payment in full for such Tour. All dates, itineraries, and prices are indicative only and the price quoted at the time of booking shall be the applicable price, subject to the surcharges that may be levied in accordance with Prices, Surcharges and Taxes above. Changes, revisions or other amendments may be made to the particulars contained in any Many Chief Tours – Many Chief Consulting Ltd website before a contract is concluded and such changes, revisions or amendments shall be incorporated as of the date of such amendment.

 

Flexibility

The Client acknowledges by booking a Tour and/or agreeing to travel with Many Chief Tours – Many Chief Consulting Ltd may require flexibility and acknowledges that they will permit reasonable alterations to the Tour and/or itinerary by Many Chief Tours – Many Chief Consulting Ltd. The Client acknowledges their understanding that the route, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents at the location where the Tour will be operated, travel interruptions, strikes, events emanating from political disputes, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Many Chief Tours – Many Chief Consulting Ltd.

 

Privacy Policy

The security and integrity of your Personal Information are important to us. All personal information is stored in a secure database to prevent unauthorized access. Please note however that no data transmission over the Internet can be guaranteed to be 100% secure. While we take all steps to ensure the safety of your data, we cannot ensure the security of information you transmit to us over the Internet.

 

Access to your personal and private information is limited to: authorized employees of Many Chief Tours – Many Chief Consulting Ltd and any of the third-party suppliers who require your information to provide the travel or other services you have requested (such as activity providers and tour guides, etc. who deliver the services you purchase through Many Chief Consulting Ltd. or that we arrange on your behalf).

 

We keep our employees and our third party suppliers and other partners informed about our policies and procedures and require strict compliance with this Policy in order to ensure your information remains protected. Unauthorized access and/or disclosure of client information are strictly prohibited. See the separate Privacy Policy document on the website for more information.

Many Chief Tours – Waiver and Release of Claims

Please read the below Waiver & Release of Claims carefully. If you are purchasing Many Chief Tours – Many Chief Consulting Ltd. tickets for someone other than yourself, please forward this waiver and release of claim document.

 

By purchasing tickets for and/or participating in the walking tours ("Tours") offered by Many Chief Tours – Many Chief Consulting Ltd. (the "Company"), and in consideration for my being allowed to participate in the Tours, the receipt and sufficiency of which is hereby acknowledged, I, and if I am not yet 18 years old, my parent or legal guardian (individually and collectively referred to below in the first person singular) agree to be bound by each of the following provisions of this waiver, release of liability, indemnification, consent to medical attention and grant of rights ("Waiver"):

 

  1. Voluntary Participation: I understand and confirm that my participation in the Tours is voluntary. I am in good health and suffer from no physical or mental condition that would make me especially susceptible to injury or disability while participating in the Tours.

  2. Understanding of Risk: I fully understand and accept all of the risks associated with my participation in the Tours including, without limitation, injury or death resulting from exposure to unfavorable weather conditions, food sickness, allergic reactions, choking, and injuries arising from self-inflicted accidents or mishaps, other participants, motor vehicles, and pedestrians. I understand that the Tours take place in public venues under conditions largely beyond Company's control.

  3. Assumption of Risk: I assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with my participation in the Tours. I accept personal responsibility for any liability, injury, loss, or damage in any way connected with my participation in the Tours.

  4. Release of Liability: Limitation of Damages. I hereby forever and unconditionally release Company and its affiliated entities, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, partners, contractors, insurers, shareholders, and directors (collectively "Released Entities"), from any and all claims, actions, damages, liabilities, losses, costs, and expenses (including, without limitation, attorney's fees) for death, injury, loss or damage of property, (collectively "Claims") in any way arising out of my participation in the Tours, including, without limitation, any and all Claims resulting from the negligence of the Released Entities. Company's liability to me will be limited to actual damages arising from Released Entities' gross negligence or willful misconduct in the performance of their duties and responsibilities hereunder; provided, however, under no circumstance shall my damages in connection with my participation in the Tours be greater than $500. Recovery of such amount shall be my sole and exclusive remedy. All liability arising out of my participation in the Tours is cumulative and not per incident. In no event shall Company be liable for any special, incidental, punitive, or consequential damages or other indirect damages, even if Company has been informed of the possibility thereof.

  5. Consent to Medical Treatment: I authorize Company to provide to me, through medical personnel of its choice, customary medical assistance, transportation, and emergency medical services. This consent does not impose a duty upon Company to provide such assistance, transportation, or services.

  6. Severability: If any provision of this Waiver is for any reason declared to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected. The invalid or unenforceable provision will be deemed modified to the extent necessary to render it valid and enforceable, and if no modification may render it valid and enforceable, this Waiver will be construed as if not containing such provision and the rights and obligations of the parties will be construed and enforced accordingly.

  7. Promotional Release: If any provision of this Waiver is for any reason declared to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected. The invalid or unenforceable provision will be deemed modified to the extent necessary to render it valid and enforceable, and if no modification may render it valid and enforceable, this Waiver will be construed as if not containing such provision and the rights and obligations of the parties will be construed and enforced accordingly.

 

THIS IS A WAIVER AND RELEASE OF LIABILITY. I HAVE READ this entire document. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY Agreeing to its provisions. By continuing to participate in the tours, I am indicating my voluntary agreement to the provisions of this WAIVER AND RELEASE OF LIABILITY. Participation in the tours by a person who is not yet 18 years old indicates that a parent or legal guardian has also read and consented to this waiver.

After you have purchased your tour(s) we will correspond with you to follow on and collect:

  • travel information – how and when you will arrive for your tour along with departure information so we can ensure your timely departure

  • passport information – this will allow us to provide additional extraction insurance thru an outside supplier as well as making the check-in process easier and quicker at each accommodation booked for you

  • emergency contact information – to provide a contact back home with information about you should an emergency occur while traveling with Many Chief Tours

  • personal preferences – to allow us to customize your travel while meeting personal expectations and provide the tour you are looking for

  • Additional personal information such as we collect age range and gender info used to organize travel and accommodations

 

Information that we do not collect:

  • Payment detail information which you use to purchase your Tour(s) How do you use this information?

 

The main reasons we collect personal information from you are:

  • to allow us to communicate with you about the Tour(s) you have purchased

  • to coordinate with our partners and suppliers in arranging your transportation and accommodations

  • to provide additional medical evacuation coverage

  • to communicate with your emergency contact person in the case of an emergency There are times when we will disclose your information to another company or partner for your benefit.

 

Many Chief Tours may share your personal information when the following occurs: we partner with local companies to provide services to Many Chief Consulting Ltd. and Many Chief Tours.

  • your personal information will be provided to the accommodations supplier

  • as our tours may be within a remote area, your emergency contact information will be provided to your tour leader as a precautionary step should an emergency occur

  • your personal information along with the health/medical insurance information you provide will be disclosed to the supplier of the extraction insurance to allow them to co-ordinate services in a timely manner when required

 

Sharing of Personal Information with Third Parties

Many Chief Consulting – Many Chief Tours partners with local companies providing local services. When required, we will share specific personal information to facilitate the booking of your Tour(s). However, except as set out in this Privacy Policy, we will not disclose any personal information without your permission unless we are legally entitled or required to do so (for example, if required by a legal process or for the purposes of prevention of fraud or other crime) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers etc.

 

How do Guests give their consent?

When you provide us with personal information to complete a transaction by placing an order, verify your credit card, or request a cancellation, we assume you consent to our collecting it and using it for that specific reason only.
